Terms of service

Hart Marketing Pty Ltd, ABN 99 686 456 235. Effective from the date of first payment.

By engaging Hart Marketing Pty Ltd (trading as By Two Harts), you (the Client) agree to the following terms and conditions.

Scope of services

Hart Marketing agrees to provide the following digital marketing services:

• Paid advertising management (Meta and Google)
• Performance reporting and analytics
• Strategy consultation and campaign planning
• Custom website build (one time), where applicable

Minimum commitment period

When your service package includes a free website build, a minimum commitment period of 3 months applies. This protects the significant time and cost invested in the design and development process.

If you terminate the service before the 3 month term is completed, you agree to pay the remaining service fee, based on the time remaining on the original agreement.

Month to month marketing management

Unless specified, each management agreement is a non locked in contract. Management can be cancelled at any time before your next payment date with written notice to Holly Atchison or Ryley Tapp.

Payments and invoicing

Payment terms are 7 days from the invoice date. Late payments may attract administrative fees.

Website ownership

Applies where a website build is included in your package. Website ownership transfers to you only upon completion of the 3 month minimum term and full payment of all fees. If services are terminated early, the website remains the property of Hart Marketing unless the early termination fee is paid.

Client responsibilities

To help us deliver the best results, clients must:

• Provide timely access to content, platforms and credentials
• Approve or respond to key deliverables within agreed timelines
• Not engage competing marketing services during the contract term

Termination

After the initial 3 month commitment, services roll over to a month to month arrangement and can be terminated by either party with 14 days' written notice.

Liability limitation

To the extent permitted by law, our liability is limited to the fees paid by the client in the prior two months.

Governing law

These terms are governed by the laws of Queensland, Australia, and disputes will be resolved in Queensland courts.
